“Anything But Fair” StubHub’s Reaction to FAIR Ticketing Act

StubHub, one of the largest ticketing platforms in the world, has issued its thoughts on the new FAIR Ticketing Act, citing that it is “particularly concerning” in a space where Live Nation and Ticketmaster own the start-to-finish process. Ever since it became a concept, the FAIR Ticketing Act has been Live Nation and Ticketmaster’s response to the outrage that has been stirred up after millions of fans expressed their anger with the system and how they could be manipulated so easily by internet resale bots.

“LNE and TM’s ‘Fair Ticketing Act‘ specifically focuses on regulating the secondary ticketing market and does not include any significant reforms to their own practices… In the wake of bipartisan calls to investigate anti-competitive and anti-consumer practices by Live Nation Entertainment, (their) solution is to point fingers and call for policies that strengthen their own control over the industry and consumers. StubHub continues to join consumer advocates in calling for comprehensive policy solutions, like the BOSS Act, that empowers fans, increase transparency across the entire marketplace, and ensures competition,” says a spokesperson for StubHub.

The BOSS Act (Better Oversight of Secondary Sales and Accountability in Concert Ticketing Act) was designed to stop “improper practices in the secondary ticketing market, such as bots and price-gouging,” but even then, some groups can’t agree on a standard process. Rock and Roll supergroup Pearl Jam wrote a five-page letter in opposition to the BOSS act, stating that the consequences, both intended and unintended, outweigh the positives, citing that the BOSS Act “primarily, if not entirely, benefits professional ticket resellers.”
